ACandS stated in 1974 that it would no longer use materials containing asbestos; however, it did not stop using asbestos entirely. According to the company’s bankruptcy filing, it continued to use asbestos until around 1985. ACandS faced nearly 250,000 lawsuits related to its asbestos products from 1981 to 2002. Most of these lawsuits claimed that the company knowingly exposed its workers to asbestos. Eventually, mesothelioma litigation against ACandS forced the company to file for Chapter 11 bankruptcy and establish an asbestos trust fund.
What Is the ACandS Asbestos Settlement Trust?
Asbestos trust funds are established to compensate victims who have been exposed to a company’s products after the company has gone bankrupt. Trust funds provide financial compensation for a victim’s losses, such as medical bills, lost wages, disability, and pain and suffering. They can also provide surviving family members with death benefits after the death of a loved one due to mesothelioma.
The ACandS Asbestos Settlement Trust was created in 2008 and originally funded with $528 million in assets. The scheduled value of a mesothelioma claim with the trust is $150,000. The percentage of a claim’s value that the asbestos trust fund will pay is currently set at 5.78 percent.
